Others will demand the service they are entitled too when paying £1800 for a mountain bike.

Too f*ckin' right!

If I spotted a crack, I wouldn't leave the dealer till the police dragged me out of there.
Don't let them get away with it, mate. What about using the sale-of-goods-act template done by that annoying twat off the One Show----> http://downloads.bbc.co.uk/theoneshow/txt/soga_letter_2.doc

Secondly, as madison would then be aware you have a known flaw in your frame prior to the warranty expiring, should that flaw develop into a failure, then they would still be obliged to honour the warranty.

No they wouldn't, it states quite clearly on page 3 of Commencals 'General Warranty Conditions' that,  [The Warranty is Void if - ] 'The bicycle has continued to be used while damaged.'

So obliged no, they may however use discretion when assessing your claim.  If you are riding a damaged frame that is within it's warranty period, in my opinion, it's a bit daft.

But if they've inspected the frame, and deemed it to be ok, then they've basically said it's not damaged.

They can say whatever they like, I'd still want it replaced.

If they say it's okay the onus is on Madison to demonstrate that the frame is still capable of meeting its design remit with said failure. Moreover I'd expect them to provide evidence to support their case, say a written statement from the manufacturer to say that the bike/frame is okay to ride. I doubt they'd do this as they would be over a barrel legally if something went seriously Pete Tong.

I agree with Bellerophon, so get it replaced. I did with mine.

I do wonder, did Madison actualy state it was OK after an inspection, has the dealer maybe provided the wrong information or such, or (I mean no offence) has the dealer actually sent it back or been "too busy"?

I would be tempted to send a polite email to Madison with a couple of pictures and the frame details and ask for confirmation of the claim. I would also send a duplicate to Commencal direct.

I know very well how something can be poorly explained under certain circumstances, my own issue was processed initially as a bike complaint regarding a shock bottoming out too much  Huh? not by any fault of the person putting in the report, But this did get rectified.
