I think there may be a crack in mine, 2006 model, without the under head tube gusset, has anyone else found any cracks in theirs?

Nah, sadly not, it's why they were so cheap, sold with no back up.

Steve,
Is that necessarily true that because they were sold cheap Commencal can deny responsibility for them? After all, Ricochet were the official, recognized UK distributor. The only available warranty at the time was written in French, and translated (through my broken French) to 2 years, workmanship or defects... as usual.
Surely it must be worth a go if you've had it less than two years?

The bottom line is, the warranty is the responsibilty of whoever you bought the frame from.
However, as it's a known defect, I'd try contacting Madison direct and see what they say.

You've got nothing to lose by asking.

It's not the price they were sold at,  but your warranty was with Ricochet, who went bust, so sold off they're stock cheap. The buyers warranty rests with the person they bought it from, not the manufacturer. It's like any Ricochet frames/bikes I sold the warranty for them is with me, I took the money so it's up to me to sort. I in turn have a warranty on said bikes/frames with Ricochet. Obviously they're now gone so officially I've no one to take the warranty up with, but it's still my job to cover the Ricochet ones I sold. As it is Madison are picking up the warranties for Ricochet bikes sold thru dealers then that are still dealers now, but it's purely a good will thing and my no means guaranteed.

Like you say, no harm in trying, but don't hold your breath. What I would say is it's pointless contacting Commencal as they will just point you to Madison the new UK importer, so I'd find a nearby Commencal dealer, go in with the bike and several large packets of Jaffa cakes, and see what they say. At the minimum your gonna have to cover shipping costs and any build up costs.

http://www.commencal.com/bike/warranty/warranty_en.pdf

Seems this article puts the onus repeatedly on Commencal, not the vendor....
Unfortunately it also references article 1641, which would be nice to read, except that it is French Civil Law, and thus not applicable in England. Nice to know that they put so much effort into translating published legal documents.

Pretty sure that only applies to France where Commencal distribute their own bikes. It's upto the distributors in each country to sort out there own warranty policy. I think.

Bottom line is this: Commencal are the single best company I've ever dealt with for sorting stuff under warranty. They can be painfully slow at times, but they stand over their product. Madison are an extremely reasonable bunch, and do all they can to keep riders riding. If you approach them in manner I suggested you may get a result. If you go waving sheets of paper at them, quoting laws your not quite aure about and generally being a bit heavy, they might well tell you you to feck off. Not that your going to do that, I'm just making the point.

In most situations, softly softly friendly friendly work better than a big stick. Cept with that Rus bloke, he likes being hit with sticks, he's weird.
